Wayne County Court sentencing for June 30

HONESDALE, PA — Wayne County District Attorney A.G. Howell announced the following cases were addressed by the Honorable Janine Edwards, President Judge Wayne County Court.

TIFFANY ANNE BROWNELL, age 34, of Moscow, PA, previously sentenced on December 3, 2020, to 18 months probation related to a Burglary, was resentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than two days nor more than 23 ½ months. She was also ordered to pay restitution of $2,198.20, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, obtain employment within 60 days of parole or provide documentation from a doctor precluding her from employment. The Defendant was found in violation of her probation when she failed to make the required payments towards the restitution.

NELSON ARTHUR COREY, age 71, of Waymart, PA, was sentenced to undergo incarceration in a State Correctional Institution for a period of not less than 21 months nor more than 120 months plus a mandatory three years probation for one count of Possession of Child Pornography-Second Offense (F2). He was also ordered to pay the costs of prosecution and is subject to a 15-year registration period as a Tier I offender. The incident occurred between July 16, 2021 and August 11, 2021 in Clinton Township, when PSP Troopers conducted undercover investigations into the internet sharing of child pornography.  They received a report concerning the possession of child pornography on the eDonkey file sharing network using client software which was reported as eMule.   On this same date, the Defendant used the Person 2 person to successfully downloaded and saved a file which was previously known through investigations to be child pornography.   On August 11, 2021, at approximately 6:15 a.m., law enforcement executed a search warrant at the Defendant’s residence.  Nearly 500 images and videos of files depicting child pornography were discovered on the Defendant’s computer 

MELISSA DELIA FINCH, age 35, of Childs, PA, was previously sentenced on Feb. 10, to 72 hours to six months in the Wayne County Correction Facility related to a Driving Under the of Alcohol, was remanded to the Wayne County Correctional Facility for the remainder of her sentence, which is Aug. 7. The Defendant was found in violation of her probation when she failed to report to her scheduled appointments and failed to make restitution payments as required.

BENEDICT KUPLACK, age 18, of San Antonio, TX, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than one month nor more than 60 months for one count of Indecent Assault (M1). He was also ordered to pay the costs of prosecution, pay restitution not to exceed $10,000, have not contact with the victim, have no unsupervised contact with any child under the age of 18 unless approved by parole, undergo a sex offender evaluation within 30 days of parole and comply with all treatment recommendations, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, continue with mental health treatment and comply with any recommendations for treatment, obtain employment within 60 days of parole or provide documentation from a doctor precluding him from employment, relinquish any firearm and ammunition to law enforcement within 24 hours and is subject to a Lifetime registration period as a Tier III offender. The incident occurred on November 28, 2021, in South Canaan Township.

ANTHONY PASCAVAGE, age 31 of Hawley, PA, previously sentenced on March 10 to six months probation related to Sale or Transfer of Firearms-Makes Materially False Written Statements, was resentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than five days nor more than 12 months with three months house arrest through the SCRAM program. He was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation and comply with all treatment recommendations and maintain or obtain employment within 30 days of parole or provide documentation from a doctor precluding him from employment. The Defendant was found in violation when he tested positive for alcohol. 

ROY WADE TIGUE, age 47, of Hawley, PA, was sentenced to undergo incarceration in a State Correctional Institute for a period of not less than 26 months nor more than 102 months for one count Theft by Unlawful Taking (M1), one count Defiant Trespass (M3), one count Driving While Operating Privileges Suspended/Revoked (S), one count DUI (M), two counts Receiving Stolen Property (M2), and Resisting Arrest (M2). He was also ordered to pay the costs of prosecution, pay a mandatory fine of $1,200, participate in and cooperate with the drug and alcohol addiction treatment in accordance with his assessment, and complete the Alcohol Highway Safety Course. The incidents occurred on April 4, 2019 in Paupack Township, October 12, 2020 in Texas Township, July 15, 2021 in Salem Township and July 20, 2021 in Paupack Township.

CHARLES STEWART WARNOTT, age 39, of Honesdale PA, was placed on probation for a period of 18 months for one count Possession of Controlled Substance – Heroin (M), one count Possession of Drug Paraphernalia (M), and one count Aiding Consummation of Crime (M2). He was also ordered to pay the costs of prosecution, pay a fine of $500, and undergo a drug and alcohol evaluation and comply with any recommendations for treatment. The incidents occurred between August 1, 2018 and January 11, 2019 in various locations throughout Pike and Wayne Counties.

MARK A. YANTORN, age 37, of Scranton, PA, previously sentenced on Feb. 17, to one month to six months in the Wayne County Correctional Facility related to Driving Under the Influence, was remanded to the Wayne County Correctional Facility for 126 days of the unserved portion of his sentence. The Defendant was found in violation of his parole because he failed to report to schedule appointments and failed to make contact with his parole officer.

KIMBERLY HOWARD, age 52, of Rochester, NY, was issued a Bench Warrant for failure to appear at court.
