Liberty man arrested following an investigation into a reported burglary

LOCH SHELDRAKE, NY — On June 25, Fallsburg Police responded to the Ahmed Trading Inc. in Loch Sheldrake for an alarm activation. Upon arrival, the patrol discovered that the back door to the business had been pried open.

Upon further investigation, surveillance footage showed a male subject, later identified as Ishmiel Agapito, enter the store unlawfully and stole multiple packs of cigarettes. Agapito was then located later on that day at a residence in Loch Sheldrake where he was taken into custody and charged with Burglary in the 3rd degree and Grand Larceny in the 4th degree, both felonies.

In accordance with bail reform laws, Agapito was released on an appearance ticket and is due back in the Town of Fallsburg Justice Court at a later date. Mr. Agapito was then turned over to the Village of Monticello Police Department on an active arrest warrant

Criminal charges are merely allegations that a defendant has committed violations of the criminal law, and as such they are not evidence of guilt. All defendants have a presumption of innocence and are entitled to a fair trial, during which it will be the burden of the State of New York to prove guilt beyond a reasonable doubt.
