Beware the ‘naked ballot’

PENNSYLVANIA — Pennsylvania’s Democratic lawmakers and voters’ rights groups have enjoyed several victories ahead of this year’s 2020 General Election. Most recently, the PA Supreme Court handed down a ruling that mail-in ballots must be counted up to three days after the polls close on November 3, as long as ballots are postmarked by November 3.

One of the Supreme Court’s other rulings has some candidates concerned, however. The high court decided that election officials must throw out mail-in ballots that are not accompanied by the required “secrecy envelopes”—a plain, inner-envelope in which voters must place their ballots. Given the vagueness of the election code on this topic, many officials counted mail-in ballots that were missing the secrecy envelopes—dubbed “naked ballots”—during last spring’s primary. But what was a grey area is now clearly black-and-white thanks to the high court: naked ballots will not be counted in the General Election.
