WOODBOURNE, NY — On October 13, Fallsburg Police responded to a residence in Woodbourne for a reported domestic dispute.
Upon arrival, patrol spoke with a female victim who alleged that her granddaughter, identified as Andrea Maccagli, had menaced her with a knife following a dispute. When Fallsburg Police attempted to make contact with Ms. Maccagli at the residence, she had barricaded herself inside of her bedroom and was refusing to open the door for responding officers. Fallsburg Police then made forcible entry into the bedroom and Maccagli was then taken into police custody. Maccagli was charged with menacing in the second degree and criminal possession of a weapon in the fourth degree, both misdemeanors. Maccagli was then arraigned in the Town of Fallsburg Justice Court by the Honorable Judge Scheinman and an order of protection was issued. Maccagli was then released and is scheduled to reappear in court at a later date.
Criminal charges are merely allegations that a defendant has committed violations of the criminal law, and as such they are not evidence of guilt. All defendants have a presumption of innocence and are entitled to a fair trial, during which it will be the burden of the State of New York to prove guilt beyond a reasonable doubt.
