The State Police at Ellenville announce the arrest of Donald Fairweather Jr. age 47 of Cragsmoor NY for Vehicular Manslaughter in the first degree, a Felony, Vehicular Manslaughter in the second degree, a Felony, two counts of Vehicular Assault in the first degree, both Felonies, Vehicular Assault, in the second degree, a Felony, and Aggravated Driving While Intoxicated, a Misdemeanor.
On September 25, 2013 the State Police at Ellenville investigated a fatal automobile accident that occurred on State Route 52 in the Town of Shawangunk. Following a lengthy investigation, it was determined that Fairweather while operating his van, crossed the center of the roadway, collided head on with another vehicle, causing the death of the operator Vadim Mushtak and serious injuries to his passenger Nadezhda Mushtak. Fairweather’s blood alcohol content was later determined to be .19%. The Ulster County District Attorney’s Office indicted Fairweather on December 31, 2013 and issued a Warrant of Arrest. On January 1, 2014 State Police of Ellenville arrested Fairweather and remanded him to the Ulster County Jail awaiting arraignment.
