Marijuana DUI, hit-and-run arrest

DAMASCUS, PA — On April 24, Trooper J. Warner with the Honesdale Patrol Unit was notified of a hut and run that occurred at approximately 4:20 AM on Flat Rock Rd, Damascus Twp. The victim related he heard and observed a loud truck driving aggressively on the road near his livestock and drove out to check. He observed a dark colored older Dodge Ram P/U doing donuts and peeling out on the road. When he stopped in the roadway, the oncoming truck side-swiped the front bumper of his truck while going around him. He attempted to follow the truck toward Galilee, but the driver was driving fast and recklessly so he stopped and contacted police.

A patrol check of the area was performed and the truck was located at the intersection of Callicoon Rd , and Church Rd., impacted into the guardrail. The operator was eventually located across the front seat, unconscious with the keys still in the ignition. The driver, identified as Matthew Bingham, 30, of Callicoon, was awakened and appeared under the influence . A strong odor of marijuana was detected within the cab of the truck, and Bingham related he had some, but that it was legal where he was from in NY. A field sobriety test was performed. Bingham was placed in custody for DUI, and transported to Wayne Memorial hospital for blood test. Charges to be filed for Hit and Run Occupied Vehicle, DUI, and possession of controlled substance, pending blood results.
