SOUTH FALLSBURG, NY — On September 19, Fallsburg Police received a report of an assault that occurred at a park in South Fallsburg. A male victim, with visual facial injuries, came into headquarters and reported that he was assaulted by a male subject, identified as Francis Chico, near the basketball courts on Griff Court in South Fallsburg.
The male victim was then transported by Empress EMS to Garnet Health Orange for further medical treatment. Fallsburg police then located Chico walking down Main Street in South Fallsburg and he was brought in for questioning by Fallsburg detectives. After further investigation, Chico was charged with assault in the second degree, a felony, and was arraigned in the Town of Fallsburg Justice Court by the Honorable Judge Scheinman. Chico was then remanded to the Sullivan County Jail and is due back in the Town of Fallsburg Justice Court at a later date.
Criminal charges are merely allegations that a defendant has committed violations of the criminal law, and as such they are not evidence of guilt. All defendants have a presumption of innocence and are entitled to a fair trial, during which it will be the burden of the State of New York to prove guilt beyond a reasonable doubt.
