Pike County District Attorney Raymond J. Tonkin announced the following criminal sentences were issued by the Pike County Court of Common Pleas Judge Gregory Chelak:

February 27, 2017

Harry Michael Morgan, age 29, of Port Jervis, NY, was sentenced to 3 months to 12 months in the Pike County Jail and fined $300.00 for the crime of Receiving Stolen Property.  Morgan took two infrared heaters with a total value of $459.98 without paying for them from a business in Westfall Township on December 16, 2015, and sold them to a business in Matamoras Borough knowing that they had been stolen.

Oleg Nemnenko, age 48, of Brooklyn, NY, was sentenced to 5 days to 6 months in the Pike County Jail, fined $300.00 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence.  The state police were dispatched to a community in Dingman Township where Nemnenko was observed driving erratically on June 21, 2014.  In speaking with Nemnenko, the trooper detected the smell of an alcoholic beverage.  Nemnenko refused to participate in a Field Sobriety Test.  Nemnenko was transported to the hospital for a blood draw where he became combative and refused testing.

James E. Longhenry, age 59, of Lords Valley, PA, was sentenced to a fine of $100.00 for the Summary Offense of Public Drunkenness and Similar Misconduct.  Eastern Pike Regional Police were dispatched to a business parking lot in Westfall Township on April 16, 2015 where Longhenry appeared intoxicated and slurring his speech.  A Field Sobriety Test was attempted, which showed impairment and a blood test confirmed the presence of Oxycodone in his blood

Amber Newell, age 32, of Port Jervis, NY, was sentenced to 18 months of probation and fined $300.00 for the crime of Retail Theft.  Newell took a generator valued at $488.00 from a business in Westfall Township on June 17, 2016, without paying for it.  She then sold it to a business in Matamoras Borough, knowing it was stolen.

Joshua Wharton, age 31, of Milford, PA, was sentenced to 3 months to 6 months in the Pike County Jail and fined $500.00 for the crime of Theft from a Motor Vehicle.  Wharton took a leaf blower valued at $300.00 from a vehicle parked at a business in Milford Township without the owner’s permission on April 17, 2014.

Michael Christopher Anderson, age 23, of Greentown, PA, was sentenced to 9 months of probation and fined $300.00 for the crime of Possession of Drug Paraphernalia.  The state police stopped Anderson for speeding and drifting across his lane of travel along SR 507 in Palmyra Township on August 29, 2016.  A consent to search his vehicle turned up a glass pipe and glass storage jar.

Jamie Helen Potts, age 23, of Greentown, PA, was sentenced to 5 days to 6 months in the Pike County Jail, fined $575.00 and had her driver’s license suspended for 12 months for the crime of Driving Under the Influence of Alcohol or a Controlled Substance, and the Summary Offenses of Registration and Certificate of Title Required and Driving While Operating Privileges Suspended or Revoked.  The state police stopped Potts for an expired registration along SR 390 in Palmyra Township on April 3, 2015.  Potts was observed to have red glossy eyes, constricted pupils and spoke in a low tone.  A Field Sobriety Test was conducted which showed impairment and a blood test confirmed the presence of Methadone and Fluoxetine in her blood.  Potts was also found to be driving on a suspended license.

Sabrina M. Cavezza, age 27, of Greentown, PA, was sentenced to 1 month to 12 months in the Pike County Jail and fined $200.00 for the crime of Possession of Drug Paraphernalia.  The state police arrived at a residence in Blooming Grove Township on August 4, 2016, to take an individual into custody.  Cavezza, also present at the residence, was found in possession of a scale used in connection with controlled substances.

Kenneth Elmore Hall, age 27, of Louisville, KY, was sentenced to 72 hours to 6 months in the Pike County Jail, fined $1,000.00 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence of Alcohol or a Controlled Substance.  Hall was observed by the state police swerving across his lane of travel along I-84 in Greene Township on December 25, 2015.  In speaking with Hall, the trooper detected the smell of Marihuana and observed Hall to be sweating profusely and have bloodshot, glossy eyes and dilated pupils.  Hall admitted to smoking Marihuana during his trip from Kentucky.  A Field Sobriety Test was conducted which showed impairment and a blood test confirmed the presence of Oxycodone and Marihuana in his blood.

John J. Visone, age 50, of Bushkill, NY, was sentenced to 6 months of the Pike Care IP Program which will include 30 days of house arrest, a fine of $750.00 and a suspension of his driver’s license for 12 months, for the crime of Driving Under the Influence of Alcohol.  The state police were dispatched to the intersection of Gaviolle Road and Milford Road in Dingman Township on January 1, 2016, where Visone was unconscious in the driver’s seat.  In speaking with Visone, the trooper detected the smell of an alcoholic beverage and observed Visone’s eyes to be glassy and his speech slurred.  A Field Sobriety Test could not be conducted because Visone could not keep his balance.  A breath test confirmed a blood alcohol content of .128%.

Maurice Kenneth Johnson, age 56, of Bushkill, PA, was sentenced to 6 months to 12 months in the Pike County Jail, fined $850.00 and had his driver’s license suspended for 18 months for the crimes of Driving Under the Influence of Alcohol or a Controlled Substance, Possession of a Controlled Substance and the Summary Offense of Driving While Operating Privileges Suspended or Revoked.  The state police spoke with Johnson who was parked along Winona Falls Road in Lehman Township on February 20, 2016, for a suspiciously long period of time.  When speaking with Johnson, the trooper detected the smell of an alcoholic beverage and observed unopened beers in the center console.  A consent to search the vehicle revealed empty Heroin bags.  A Field Sobriety Test was conducted which showed impairment and a blood test confirmed the presence of Morphine, Fetanyl and Metabolite in his body.

Rose Mary Defebo, age 53, of Lackawaxen, PA, was sentenced to 90 days to 5 years in the Pike County Jail, fined $2,000.00 and had her driver’s license suspended for 18 months for the crimes of Driving Under the Influence of Alcohol or a Controlled Substance and Driving While Operating Privilege is Suspended or Revoked.  The state police were dispatched to a one-vehicle crash along SR 590 in Lackawaxen Township on March 20, 2015.  Defebo, the driver of the vehicle, admitted she had consumed pain medication but had not been drinking.  A Field Sobriety Test showed impairment and a blood test confirmed the presence of Oxycodone in her blood which she did not have a prescription for.

Jesse Lee Fotusky, age 29, of Lake Ariel, PA, was sentenced to 3 months to 1 year in the Pike County Jail, fined $300.00 and had his driver’s license suspended for 6 months for the crime of Possession of a Controlled Substance.  The state police pulled over Fotusky on August 5, 2016, along SR 507 in Greene Township for an improperly placed registration sticker and for erratic driving.  When the glove box was opened by Fotusky to retrieve the registration, a spoon containing residue was observed.  Fotusky was found in possession of a Klonopin pill and a pipe in his pocket and two packages of Heroin, an empty packet, Klonopin pills and Suboxone strips which he did not have a prescription for.

Daniel James Levens, age 32, of Hawley, PA, was sentenced to 12 months of probation and fined $300.00 for the crime of Possession of Drug Paraphernalia.  The state parole were conducting a home visit on an individual at an apartment in Palmyra Township on June 6, 2016, when they encountered Levens who was found in possession of glassine packets, rolling papers, a grinder and a scale.

Terry L. Kyser, age 59, of Port Jervis, NY, was sentenced to 36 months of probation and fined $1,200.00 for 4 counts of the crime of Indecent Exposure.  Kyser exposed his genitals and masturbated at a parking area of the state forest land in Westfall Township on August 9, 2015.

Kurtis R. Kimble, age 28, of Dingmans Ferry, PA, was sentenced to 12 months of probation, fined $300.00 and had his driver’s license suspended for 6 months for the crime of Possession of a Controlled Substance.  Eastern Pike Regional Police responded to a business parking lot in Westfall Township on March 30, 2016, where Kimble was found unresponsive in his vehicle which was running, Alprazolam pills were observed on the front seat and a hypodermic needle on the back seat.

Thomas W. Dubiel, age 57, of Honesdale, PA, was sentenced to 5 days to 6 months in the Pike County Jail, fined $1,000.00 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence.  Dubiel was stopped by the state police on August 13, 2016, for speeding along SR 590 in Lackawaxen Township.  In speaking with Dubiel, the trooper detected the smell of an alcoholic beverage and observed Dubiel’s eyes to be glassy and bloodshot and his speech slurred.  A Field Sobriety Test was conducted which showed impairment and a breath test confirmed a blood alcohol content of .093%.

Patrick Niedzwiecki, age 20, of Hawley, PA, was sentenced to 2 years of probation, fined $500.00 and had his driver’s license suspended for 6 months for the crime of Receipt in Commerce of a Controlled Substance.  Niedzwiecki, was found in possession of Marihuana at his residence in Lackawaxen Township on December 11, 2015, which he had received in commerce from an individual not authorized to sell or dispense Marihuana.

Matthew Targonski, age 49, of Milford, PA, was sentenced to 2 years of probation and fined $300.00 for the crime of Retail Theft.  Targonski took $134.00 worth of merchandise from a business in Westfall Township on July 29, 2016, without paying for it.

Christopher John Kelly, age 27, of Milford, PA, was sentenced to 30 days to 6 months in the Pike County Jail, fined $750.00 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence.  The state police responded to a one-vehicle crash involving Kelly on July 3, 2016, along SR 2001 in Dingman Township.  Kelly admitted to the trooper that he should not have been driving because he had been drinking and agreed to a Field Sobriety Test.  The test showed impairment and a breath test confirmed a blood alcohol content of .155%.

Kenneth Earl Swingle, age 29, of Hawley, PA, was sentenced to 88 days to 12 months in the Pike County Jail, followed by 6 months of probation and fined $800.00 for the crimes of Forgery and Possession of Drug Paraphernalia.  Between August 18, 2016 and August 31, 2016, Swingle took several checks from an individual’s checkbook at their Greene Township residence without permission, wrote the checks to himself, forged the account holder’s signature and cashed the checks receiving a total of $1,700.00.  When the state police served Swingle with a warrant for his arrest on September 22, 2016, at his residence in Blooming Grove Township, he was found in possession of a needle, spoon and empty baggies.

Paul Joseph Oswald, age 31, of Dingmans Ferry, PA, was sentenced to 90 days to 5 years in a state correctional facility, fined $1,800.00 and had his driver’s license suspended for 18 months for the crime of Driving Under the Influence of Alcohol or a Controlled Substance.  The state police stopped Oswald on September 9, 2015, for failing to lower his high beams while traveling along Route 6 in Blooming Grove Township.  The trooper detected the smell of an alcoholic beverage while speaking with Oswald and observed his eyes to be glassy, red and bloodshot.  Oswald admitted to the trooper of drinking prior to driving.  While attempting to complete the Field Sobriety Test, syringes fell out of Oswald’s pocket and a search revealed empty glassine packets, syringes and Heroin.  A blood test confirmed the presence of Morphine and a blood alcohol content of .054% in his body.

Melissa Floystad, age 47, of Dingmans Ferry, PA, was sentenced to 33 months to 72 months in a state correctional facility, to run consecutive with her Luzerne County sentence, fined $1,300.00 and had her driver’s license suspended for 12 months for the crimes of Delivery of a Controlled or Counterfeit Substance, Flight to Avoid Apprehension, and 2 counts of Possession of Drug Paraphernalia.  Floystad was a passenger in a vehicle that was stopped by the state police along SR 6 in Milford Township on March 21, 2016, for a faulty brake light.  A consent to search Floystad’s purse revealed empty Heroin packets, needles, a tourniquet and a spoon.  On April 22, 2016, at a business parking lot in Westfall Township, Floystad ran from police who had a warrant for her arrest.  Between January 1, 2014 and April 22, 2016, Floystad provided Heroin to a minor child in Westfall Township. On March 4, 2016, state police responded to an inn located in Dingman Township for a report of suspected drug activity.  Floystad was found in possession of needles, baggies, a tourniquet and various drug paraphernalia.

Christina L. Uhelsky, age 34, of Hawley, PA, was sentenced to 6 months of probation and fined $200.00 for the crime of Recklessly Endangering Another Person. Uhelsky left her child unattended in a vehicle parked outside of a business located on SR 739 in Blooming Grove Township on August 30, 2016.
