Trooper shot at DUI arrest recovering

FOUNTAIN HILL, PA — Cpl. Seth Kelly, a Honesdale native and a corporal with the Pennsylvania State Police, was upgraded from critical to stable condition on November 13. That was after two surgeries to treat multiple gunshot wounds suffered after Kelly and another officer pulled over a man suspected of driving under the influence.

Kelly and Trooper Ryan Sieple pulled over 22-year-old Daniel Clary from Monroe County. The officers were administering blood tests, and Clary tested positive for driving under the influence. When Sieple went to put the cuffs on Clary he began to resist, and the three ended up wrestling on the ground. At one point the troopers used a taser on Clary. But Clary was able to break away from the officers, and ran back to his vehicle and pulled a gun from it.

Troop M Commander Richard D’Ambrosio said Clary then immediately fired on both troopers. He said, “Kelly was hit several times… even after being hit, Kelly and Sieple both returned fire, shooting the actor multiple times. Clary at this point got back into his vehicle and drove away from the scene; he actually drove himself to a hospital. Kelly was gravely injured at this point; he fell over the guide rail. Even through all of this—he carries a tourniquet on his belt—and he had the wherewithal to pull the tourniquet off his belt and apply it to one of his wounds, more than likely saving his own life.”

When Clary showed up at Easton Hospital he told staff that he had been involved in a shootout with state police. The hospital informed the state police who took him into custody. He was transferred from the hospital to prison on November 12.
