Support for Malone and Kavanagh

We write to urge the support of all voters for the re-election of Judge Michael Kavanagh and Judge Bernard Malone to the Supreme Court of the 3rd Judicial District of the State of New York.

As judges who have had the privilege of serving on the state's highest court—the Court of Appeals—we are not in the practice of endorsing candidates for elective office. However, judges Kavanagh and Malone are both outstanding jurists, who have served on the Supreme Court with honor and distinction, and it is, in our view, imperative that they both be allowed to continue their good work on behalf of the people of this judicial district.

As Supreme Court judges, both were appointed first by Governor Pataki and then by Governor Spitzer to serve on the Appellate Division of the Supreme Court. Both have since been found "highly qualified" by the Independent Judicial Election Qualification Commission—a bipartisan group of respected members of our community from all walks of life, who are intimately concerned with the operation of our legal system. This rating comes as no surprise to those of us who are familiar with Judges Kavanagh and Malone and their work as Justices of the Supreme Court.

Support for Judge Kavanagh and Judge Malone will be a vote for judicial excellence, and will serve to promote good government in our community.

Retired Court of Appeals Judge (1993-2002)
