Port Jervis felony narcotics arrests

At 4:19 AM on December 7, 2014, Port Jervis Police responded to a disturbance call at the Port Jervis Municipal parking lot on lower Pike Street. Upon arrival officers observed a large group of individuals watching two males engaged in a fight. Police arrested Kem Garland, age 26, of Mount William Street, Port Jervis, and Torey Posey, age 36, of 100 Sekani Trail, Albrightsville, PA, and charged them with the violation of Disorderly Conduct.

Posey was also charged with Resisting Arrest, a class A misdemeanor, and Harassment in the Second Degree, a violation. Police allege that Posey physically resisted officers as they were taking him into custody.

Subsequent to his arrest, Detectives charged Posey with Criminal Possession of a Controlled Substance in the Third Degree (intent to sell), a class B felony, and Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony, after a quantity of the street drug Molly, packaged for sale, was recovered from his person. Molly is the street name for a drug that generally contains MDMA (the synthetic chemical in ecstasy) along with other synthetic chemicals.

Garland was released on his own recognizance pending a future court appearance. Posey was remanded to the custody of the Orange county Sheriff’s Office without bail (2 or more prior felony convictions) pending further court action.

A criminal charge is an accusation. All persons are considered innocent until proven guilty in a court of law.
