On July 2, 2013, State Police in Middletown announce the arrest of Maileny Gonzalez, age 35, of Highland, NY for the felony charges of assault in the second degree and aggravated unlicensed operation of a motor vehicle in the first degree. She was also charged with two misdemeanor counts of endangering the welfare of a child and one count of operating a vehicle without an interlock device.

On June 21, 2013 at approximately 6:44 PM, Gonzalez was driving south on Mud Mills Road in the Town of Wallkill. She drove into the northbound lane, and struck a vehicle operated by Kenneth Han, age 48, of Mountaindale, NY.

Han’s wife, Asha Han, age 41, was airlifted to Westchester Medical Center, where she remains in critical condition with a head injury. Mr. Han was transported to Orange Regional Medical Center and treated for minor injuries. Gonzalez’s 10 year-old son was also airlifted to Westchester Medical Center, where he was treated for a head injury and released. A five year-old child in Gonzalez’s car was not injured.

The investigation conducted by State Police revealed that Gonzalez’s privilege to operate a motor vehicle was revoked because of a prior conviction of Leandra’s Law. At the time of the collision, Gonzalez was using a smartphone to access the Internet while she was driving.

Gonzalez was arraigned before Town of Wallkill Justice Joseph Owen and committed to Orange County Jail in lieu of $50,000 cash bail.
