Sullivan County District Attorney Jim Farrell announced today that Paul Curry, 38, of Neversink, N.Y. was sentenced in Sullivan County Court to 25 years in state prison and 20 years of post release supervision for Rape in the 1st Degree.

Farrell said Curry had previously pled guilty to engaging in sexual intercourse with a 12 year old minor in July of 2011 in the Town of Neversink. Under the terms of the plea agreement, Curry faced a minimum of 17 years in state prison and a maximum of 20 years in state prison, however, prior to sentencing Curry contacted the underage victim in direct violation of the court’s order of protection.

Curry was out on bail at the time he contacted the victim. After it was discovered that he violated the order of protection Curry was again arrested by the Sheriff’s Department and remanded pending sentencing.

Curry attempted to withdraw his guilty plea after the People moved to have the sentence increased as a result of the violation of the order of protection and the terms and conditions of the plea as set down by County Court Judge Michael McGuire.

Farrell said that his office asked McGuire to impose the maximum sentence of 25 years in state prison and 20 years of post release supervision. McGuire also sentenced Curry to a $5,000 fine, a $1,000 sex offender fee, a $50 DNA fee, sex offender treatment, and ordered Curry to have no contact with any child whatsoever. Curry will be required to register as a sex offender when released from prison.

Farrell praised the work of the Sullivan County Sheriff’s Department, who investigated the case and secured critical DNA evidence which resulted in the conviction here and Assistant District Attorney Rob Zangla who handled the prosecution, “The sentence here reflects the extremely serious nature of the defendant’s criminal behavior. The hard work of the detectives and officers of the Sheriff’s Department and ADA Zangla has resulted in a sexual predator being removed from our community for a very long time so he cannot harm another child.”
